Terms of Service

These Terms govern your use of Duyve, a personal dispatch platform operated by Viktor.

These Terms of Service ("Terms") govern your use of Duyve ("we", "us", "our"), a personal dispatch platform operated by Viktor, a private individual based in Belgium.

By creating an account or using Duyve, you agree to these Terms. If you do not agree, please do not use the platform. For questions, contact us at hello@duyve.app.

1. What Duyve Is

Duyve is a tool that allows individuals to create beautifully designed personal email dispatches and send them to private groups of people they personally know. Duyve is not a marketing platform, a mass emailing service, or a business communication tool.

Duyve beta v1 is an early service. Features, limits, access, and availability may change as the product is tested and improved.

2. Your Account

2.1 Eligibility

You may use Duyve if you are at least 13 years old. To purchase a paid plan or make any payment, you must be at least 18 years old or have the consent of a parent or legal guardian.

2.2 Registration

You must provide accurate information when creating your account. You are responsible for keeping your login credentials secure. You may not share your account with others.

2.3 One account per person

Each account is for personal use by one individual. You may not create accounts on behalf of others or operate multiple accounts to circumvent usage limits.

2.4 Account termination

You can delete your account from Settings or contact hello@duyve.app for help. We may suspend or terminate your account if you violate these Terms, without prior notice in cases of serious violations.

3. What You Can and Cannot Do

3.1 You can

  • Create personal dispatches and send them to people you personally know
  • Invite people to your clubs via invite links
  • Upload photos and personal content to include in your dispatches
  • Use Duyve for personal, non-commercial communication

3.2 You cannot

  • Send unsolicited emails to people you do not personally know
  • Use Duyve for commercial marketing, advertising, or promotional campaigns
  • Import purchased, rented, or scraped email lists
  • Use misleading subject lines, sender names, invite links, or unsubscribe wording
  • Send content that is illegal, harmful, hateful, sexually explicit, or harassing
  • Impersonate another person or organisation
  • Send non-consensual intimate content, exploitation, or content that violates privacy rights
  • Use Duyve to distribute malware, phishing attempts, or fraudulent content
  • Attempt to circumvent usage limits through multiple accounts or automated means
  • Reverse engineer, copy, or redistribute any part of the Duyve platform
  • Use automated tools, bots, or scripts to interact with the platform

Violations of these rules may result in immediate account termination and, where required by law, reporting to relevant authorities.

4. Your Content

4.1 Ownership

You retain full ownership of all content you create on Duyve: your dispatches, photos, and text. Duyve does not claim any rights to your content.

4.2 Licence to operate

By uploading content to Duyve, you grant us a limited, non-exclusive licence to store, process, and transmit that content solely for the purpose of providing the service to you. We do not use your content for any other purpose.

4.3 Your responsibility

You are solely responsible for the content you create and send. You confirm that:

  • You have the right to use and share any photos or text you upload
  • Your content does not infringe the intellectual property rights of others
  • Your content does not violate privacy, publicity, confidentiality, or image rights
  • Your content complies with all applicable laws

4.4 Content removal

We reserve the right to remove or disable access to content that violates these Terms or applicable law, block sends, investigate abuse reports, preserve relevant records where appropriate, and terminate accounts that repeatedly or seriously violate content rules.

5. Sending Dispatches and Consent

By using Duyve to send dispatches, you confirm that:

  • Every recipient is someone you personally know
  • You have a genuine personal or professional relationship with each recipient
  • You have a valid basis, permission, or reasonable expectation to email each recipient
  • You have not obtained email addresses from public lists, data brokers, or automated scraping
  • When you manually add a contact, you confirm their permission as required during the add process

Duyve logs consent confirmations including timestamp and IP address. This documentation may be used in the event of a complaint or legal dispute.

6. Beta Limits and Enforcement

Duyve may apply send limits, recipient limits, upload limits, rate limits, account review, temporary blocking, content removal, or account suspension to protect recipients, Duyve, and service providers.

During beta, Duyve may change or remove features, adjust limits, temporarily pause access, or discontinue access where needed for reliability, abuse prevention, security, or product development.

7. Duyve Branding

Dispatches may include "Made with Duyve" branding. Removing, hiding, or misleadingly altering required Duyve branding is not permitted unless Duyve provides a feature that allows it.

8. Email Delivery

Duyve delivers dispatches via third-party email infrastructure. While we take reasonable steps to ensure reliable delivery, we cannot guarantee that every email will be delivered or that it will not be filtered as spam by the recipient's email provider.

We are not liable for non-delivery, delays, or filtering of dispatches by third-party email systems.

9. Availability and Changes to the Service

9.1 Availability

We aim to keep Duyve available at all times but cannot guarantee uninterrupted access. We may perform maintenance, updates, or experience technical issues that temporarily affect availability.

9.2 Changes

We reserve the right to change, limit, or discontinue any feature of Duyve at any time, especially during beta. Where possible, we will provide reasonable notice of significant changes.

9.3 Discontinuation

If we discontinue Duyve entirely, we will try to provide reasonable notice by email to registered users where practical, giving you time to save or delete your content.

10. Limitation of Liability

To the maximum extent permitted by Belgian and EU law, Duyve is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the platform. Our total liability to you for any claim arising from these Terms or your use of Duyve shall not exceed the amount you paid us in the 3 months prior to the claim.

Nothing in these Terms limits our liability for fraud, gross negligence, or any liability that cannot be excluded under applicable law.

11. Indemnification

You agree to indemnify and hold harmless Viktor and Duyve from any claims, damages, or expenses, including legal fees, arising from:

  • Your violation of these Terms
  • Content you send through Duyve
  • Your violation of any third-party rights

12. Intellectual Property

The Duyve name, logo, platform design, and codebase are the intellectual property of Viktor. You may not use, copy, or imitate any part of the Duyve brand without written permission.

13. Governing Law and Disputes

These Terms are governed by Belgian law. Any disputes arising from these Terms or your use of Duyve shall be subject to the exclusive jurisdiction of the courts of Belgium.

If you have a complaint or dispute, please contact us first at hello@duyve.app. We will do our best to resolve it informally before any formal proceedings.

14. Changes to These Terms

We may update these Terms from time to time. When we make significant changes, we will update the "Last updated" date and notify you by email. Your continued use of Duyve after the changes take effect constitutes acceptance of the new Terms.
